I'm not sure I follow what the problem is, but I guess what you need to use is:

new UIPopoverController (UIViewController viewController)

or:

base (viewController)

if you are subclassing it.

Is that what you mean?

Okay, issue is just that the default ctor for UIPopoverController will throw an error in iOS5
