as of iOS 5 the designated initializer for UIPopoverController is initWithContentViewController:(UIViewController*)viewController...and not init.

I'm not sure I follow what the problem is, but I guess what you need to use is:
new UIPopoverController (UIViewController viewController)
if you are subclassing it.
Is that what you mean?
Ugh, I know you explained the issue to me in IRC but now I forget what it was and sadly I didn't update the bug right away.
Okay, issue is just that the default ctor for UIPopoverController will throw an error in iOS5
